Terms of Use

1. Agreement and app license

These Terms of Use ("Terms") govern your use of the FocusCurve mobile application, website, and related services (together, "FocusCurve"). FocusCurve is operated by Daniela Šimková ("we," "us," or "our"). By downloading, accessing, purchasing, or using FocusCurve, you agree to these Terms. If you do not agree, do not use FocusCurve.

Your license to use the iOS application is also subject to Apple'sStandard End User License Agreement ("Apple Standard EULA"), which is incorporated into these Terms. These Terms supplement the Apple Standard EULA; the Apple Standard EULA controls if the two conflict about the application license.

You must be legally able to accept these Terms in your country. FocusCurve is intended for people aged 17 and over and is not directed to children.

2. What FocusCurve provides

FocusCurve is an educational, on-device tracking and visualization tool. It can help you record medication, caffeine, symptoms, mood, side effects, sleep-related observations, inventory, and other information you choose to enter. It can also display estimated timelines based on published models and parameters you provide.

Estimates are approximate and may differ from what you experience. Features, supported medications, models, and availability may change as FocusCurve is maintained and improved.

3. Medical and safety notice

Do not use FocusCurve to decide whether, when, or how much medication to take, to change a prescribed treatment, or as a substitute for a clinician's judgment. Medication and sleep estimates are based on generalized models and user-provided information; they do not measure your actual body levels or guarantee when an effect will begin, end, or when you will be able to sleep.

Always follow the instructions provided by your prescriber and pharmacist. Contact a qualified healthcare professional with medical questions. In an emergency, contact your local emergency services immediately.

4. Privacy and local data

Health-related records you enter are designed to remain on your device. FocusCurve has no account or cloud service that can recover those records for you. Deleting records, deleting all app data, or uninstalling the app may be irreversible unless you created and retained an export yourself.

Purchases, optional pseudonymous product analytics, diagnostics, and communications are handled as described in thePrivacy Policy. You are responsible for securing your device and deciding what information to include when you voluntarily export data or contact support.

5. FocusCurve Plus

FocusCurve Plus provides full access to tracking, deeper patterns, and planning tools. The functionality available without Plus may vary by the version or access option offered to you. Before you confirm a purchase, the current paywall identifies what the selected option unlocks, its billing period, localized price, renewal terms, and any eligible introductory offer.

Digital access is sold only through Apple's in-app purchase system. FocusCurve does not offer a separate web checkout. The Apple purchase sheet is shown before confirmation and controls the final localized price, taxes, and transaction terms presented to you.

Subscriptions

Monthly and annual subscriptions are billed through your Apple Account and automatically renew for the same period unless you cancel before the end of the current subscription period. For a free or discounted trial, cancel at least 24 hours before it ends, or earlier if Apple displays a different deadline. Apple controls billing, renewal timing, taxes, eligibility, and payment processing. Deleting FocusCurve does not cancel a subscription.

You can view, change, or cancel a subscription in your Apple Account'ssubscription settings. Cancellation stops future renewals; access normally continues until the end of the already-paid period.

Free trials and introductory offers

If Apple determines that you are eligible for a free trial or introductory offer, its length and the price charged afterward are shown before purchase. Unless you cancel at least 24 hours before the trial ends, or by any earlier deadline Apple displays, it may convert to the selected paid subscription. Trial and offer eligibility are controlled by Apple and may be limited to one per subscription group.

Lifetime access and prior purchasers

A lifetime purchase is a one-time, non-consumable purchase that grants FocusCurve Plus access for the supported life of the FocusCurve application. It does not promise perpetual maintenance, compatibility with every future device or operating system, or access to a materially separate future product or service. Nothing in this paragraph limits rights that cannot be limited under applicable consumer law.

People who purchased an eligible paid version of FocusCurve before the Plus transition keep Plus access without another purchase. Eligibility depends on App Store purchase history and successful entitlement verification. Use Restore Purchases if expected access is missing.

6. Payments and refunds

Apple processes all FocusCurve in-app purchases. Prices are displayed by Apple in your local currency and may include or add applicable taxes. We do not receive or store your full payment-card details.

Refund requests and billing disputes for App Store purchases are handled by Apple under its policies and applicable law. You can request a refund atreportaproblem.apple.com. If an entitlement is refunded, revoked, expires, or cannot be verified, Plus access may end without deleting your locally stored records.

7. Acceptable use

You agree not to:

• use FocusCurve unlawfully or in a way that harms another person;
• circumvent purchase, entitlement, security, or access controls;
• reverse engineer, copy, redistribute, resell, or create derivative works except where applicable law permits;
• interfere with the application, website, providers, or other users; or
• present FocusCurve estimates as measured clinical results or professional medical advice.

8. Ownership and feedback

FocusCurve, including its software, visual design, text, graphics, and trademarks, is owned by us or our licensors and is protected by applicable intellectual-property laws. These Terms grant only the limited right to use FocusCurve under the Apple Standard EULA; they do not transfer ownership.

If you voluntarily send an idea or suggestion, you allow us to use it to improve FocusCurve without restriction or compensation. Do not send confidential information or health details in product feedback.

9. Availability, updates, and third parties

We may update, improve, remove, suspend, or discontinue features when reasonably necessary, including for safety, legal compliance, platform changes, or maintenance. We do not guarantee that FocusCurve will always be available, error-free, or compatible with every device or operating-system version.

FocusCurve relies on Apple and may use service providers such as RevenueCat, PostHog, and Sentry. Their availability and terms may affect purchases, analytics, or diagnostics. You must also comply with applicable third-party terms, including Apple's terms, when using FocusCurve.

10. Warranties and limitation of liability

To the maximum extent permitted by law, FocusCurve is provided "as is" and "as available," without warranties of accuracy, fitness for a particular purpose, uninterrupted availability, or medical suitability. We do not warrant that an estimate will match your individual response.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or opportunity arising from use of or inability to use FocusCurve. We do not exclude or limit liability where doing so is prohibited, including mandatory consumer protections or liability for fraud, gross negligence, or personal injury where applicable law does not permit limitation.

11. Termination

You may stop using FocusCurve at any time. You remain responsible for canceling any active subscription through Apple. We may suspend access where reasonably necessary for unlawful use, fraud, abuse, security, or legal compliance. Provisions that by their nature should survive termination, including ownership, disclaimers, liability, and governing law, will survive.

12. Changes and governing law

We may update these Terms to reflect changes to FocusCurve, providers, law, or business practices. The current version and its effective date will remain available on this page. Material changes will be communicated where required. Continued use after the effective date means you accept the updated Terms.

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections or courts available under the law of your country of residence.
